You are using a very good auction programme but you need to change the templated to make it yours you also need to change your logo by the looks you have made it using text which is a no no!!!.

I will tell you one thing and this gos for everyone else running an auction website or any type of website your Terms and Conditions are the most important thing it is like a life insurance for your website if there is a problem between a buyer and the seller and they blame it on you and you having got the right Terms and Conditions to protect you and your site you could be sued thousands of pounds and end up with a criminal record if you haven't got those important things then I strongly suggest you take your site offline immediately if I wanted to I could nearly sue every single auction website on this form as nearly none of you have got the right Terms and Conditions and I could make a big profit just from this forum.

Hmmmm! Rob you are right that sites would be well advised to have terms & conditions. As I understand it, the auction software that most sites use usually comes with some suggested ones but obviously a site should tweak it to their own situation, preferably with legal advice. But to be blunt, it is nonsense to keep going on about your being able to sue sites because they haven't got what you consider are the correct terms & conditions.

Unless you are a member of these sites you have no contractual relationship with the owners so there are no contractual issues you could legally sue them for. You may not like them, and I don't like a lot of them, but you and I haven't suffered any loss because we're not members. Even if one was a member and in some rather difficult to imagine circumstances sued the site owner, it would be a civil matter, dealt with in a civil not a criminal court. The site owner, if they lost, would not end up with a criminal record. It's a different matter if there has been a criminal offence such as fraud or failure to comply with statutory requirements. But a dispute between a site owner and a member is a civil matter.
